TICKET HOLDER TERMS OF AGREEMENT

Terms of Agreement & Rules for Ticket Holders for the 2021 Fall Parade of Homes

 

By acceptance and/or use of a ticket, or any electronic form thereof, (collectively, the “Ticket”) for the Madison Area Builders Association 2021 Fall Parade of Homes event (“Event”) at homes entered and marketed as a Fall Parade Home (“Parade Homes”), the Ticket holder (“Holder”), on behalf of himself/herself and any minor(s) accompanying Holder (“Minor”), acknowledges that attendance is voluntary and agrees to the following: 

 

  1. COVID-19 is an extremely contagious disease that can lead to severe illness and death. An inherent risk of exposure to COVID-19 exists in any public place regardless of precautions that may be taken; 

 

  1. That the Holder accepts and assumes the risk that COVID-19 will spread, even in ideal conditions;

  2. That risk of serious illness or death may result from the spread or transmission of the virus at the Fall Event resulting from their own actions or inactions, but also from the actions, inactions or negligence of others, and they voluntarily agree to assume this risk.

 

THAT THE HOLDER HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE THE MADISON AREA BUILDERS ASSOCIATION, FALL PARADE OF HOMES, Participating Builders and Homeowners, and all related entities and affiliates, together with their respective owners, officers, directors, employees, agents, licensees, sponsors, and vendors (collectively, the “Released Parties”) FROM ALL LIABILITY TO THE HOLDER, his or her personal representatives, assigns, heirs, and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFOR ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED ARISING OUT OF THE EXPOSURE TO COVID-19 AT THE EVENT CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES (BUT NOT INCLUDING INTENTIONAL OR RECKLESS ACTS OF THE RELEASED PARTIES).

  1. THAT THE HOLDER HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Released Parties and each of them FROM ANY LOSS, LIABILITY, DAMAGE, OR COST he or she may incur arising out of or related to THE ACTIVITIES CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES (BUT NOT INCLUDING INTENTIONAL OR RECKLESS ACTS OF THE RELEASED PARTIES);   

  2. THAT THE HOLDER HEREBY acknowledges he or she had the opportunity to contact a representative of the Madison Area Builders Association on behalf of the Released Parties to discuss and/or bargain regarding any of the terms set forth herein.

 

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY USING THE TICKET AND HAVE DONE SO FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO HOLDER.

 

The Released Parties recognize the current situation facing the local community, and are making health and safety for our Event attendees, staff, and builders an utmost priority for the duration of the Event. As our society slowly moves towards fully reopening, the Released Parties will be following public health guidelines as we strive to provide a safe and enjoyable environment.

 

Precautions will include, but are not limited to:​

  • Processes to limit physical interactions with staff and products.

  • Daily cleaning within each home by builders, as well as intermittent cleaning during the hours of the Event.

  • Limiting touch points, like door handles by removing some doors and furniture from the homes.  Roping off high touch areas.

  • Providing hand sanitizer at the entry of all Parade Homes.

  • Event employees and Event attendees who have a fever or other symptoms of COVID-19 are asked to stay home and not attend the Event in person.

 

On behalf of all those involved in the Madison Area Builders Association, the Released Parties, and the Fall Parade of Homes, we are committed to everyone’s continued health and safety.
